The following Terms of Use outline the general terms and conditions for using this website and participating in the Market Samurai Affiliate Programme. By accessing this website, you are indicating your acknowledgement and acceptance of these terms and conditions. Use of misleading forms of marketing, including but not limited to "car crash" advertising (e.g. sending emails titled "Market Samurai Scam!" that use shock value to generate interest), are prohibited by these Terms of Use. Any use of marketing methods deemed inappropriate or misleading by Noble Samurai may result in the termination of an Affiliate's account and no Affiliate commission being paid.

Disclaimer and Limitation of Liability

  1. All content is provided "as is" and without warranties of any kind, either express or implied;
  2. Noble Samurai expressly disclaims all warranties of any kind including, without limitation, implied warranties of merchantability and fitness for a particular purpose;
  3. Noble Samurai does not warrant that the functions contained in any content or any Communications Facility or user or member access to this website will be uninterrupted or error-free, that any defects will be corrected or that this website or the server which stores and transmits content to you are free of viruses or any other harmful components;
  4. Noble Samurai does not warrant or make any representation regarding user or member access, or the results of user or member access, to this website (including any linked websites).

Under no circumstances (including but not limited to any act or omission, whether negligent or not, on the part of Noble Samurai) will Noble Samurai or its affiliates be liable for any direct or indirect, incidental, special and/or consequential damages or loss of profits whatsoever which result from any use or access of, or any inability to use or access, this website or any content contained within.

Affiliate Payments

As a participant in the Affiliate Programme you are eligible for a 48% commission based on sales linked to your affiliate account. If at any time you violate any of the Market Samurai or Affiliate Programme Terms of Use we do not guarantee that any payment of commission will be made to you. Any communication on our behalf regarding the payment of commission payments is to be considered an estimate and any amounts, timeframes or other specifics are subject to change without notice.

Market Samurai Materials

The following materials are considered part of the Market Samurai Affiliate Programme package:

  • the Market Samurai software package and all modules and features contained therein;
  • the Niche Marketing Black Book;
  • all training and instructional materials created by Market Samurai (including those materials affiliated with the Thirty Day Challenge).

    • Bonus Material

    As a participant in the Market Samurai Affiliate Programme you will not make offer of any additional products, services or other material above those specified as Affiliate products in the Terms of Use unless:

    1. you are, at the time of offer, able to supply the additional material within the time limitations you have guaranteed;
    2. you agree to withdraw the offer immediately if, at any time, you are unable to supply the additional material offered;
    3. any additional material supplied outside of the Market Samurai materials must be supplied lawfully and you must either own the material or have expressly written permission from the rights holder of the material for its redistribution;
    4. it is understood by all parties that the offer of those additional materials is an agreement between you and the third party and is not in any way guaranteed, commissioned or approved by us and we will not be held liable for any losses or damages resulting from the use of these materials.

    Noble Samurai makes no express or implied claims that you will make money as a result of purchasing Noble Samurai products or following advice on this website.

    To the fullest extent permitted by law, Noble Samurai's liability for breach of any implied warranty or condition which cannot be excluded is limited to the amount paid by you to Noble Samurai for the applicable content, product or service out of which liability arose.

    Indemnity

    You will indemnify and hold harmless Noble Samurai, its subsidiaries, affiliates, licensors, employees, agents, officers, directors, shareholders and contractors ("Indemnified Parties") harmless from any breach of these Terms of Use by you, including any use of content other than as expressly authorised in these Terms of Use. You agree that the Indemnified Parties will have no liability in connection with any such breach or unauthorised use, and you agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses and legal fees of the Indemnified Parties. You will also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your use of the information accessed from this Site.

    Termination

    We reserve the right to make changes without notice to these Terms of Use. We may suspend or terminate your access to this website and the Affiliate Programme at any time without notice. In the event of termination, all restrictions imposed on you, licenses granted by you and all Noble Samurai disclaimers and limitations of liability set out in the Terms of Use will survive.

    Miscellaneous

    All information provided by Noble Samurai are provided in good faith and we will do everything in our power to ensure the information is accurate. In the event that an inaccuracy occurs it is the responsibility of the discovering party to make the inaccuracy known to Market Samurai staff.

    These Terms of Use will be governed by and interpreted in accordance with the laws of the State of Victoria, Australia and shall be subject to the jurisdiction of the courts of Victoria, Australia. If any provision of these Terms of Use is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Terms of Use which will continue in full force and effect.
